1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Doomersion ("we," "us," or "our") governing your use of the Doomersion mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 12 years of age to use Doomersion. By using the Service, you represent and warrant that:

• You are at least 12 years old
• You have the legal capacity to enter into this agreement
• If you are between 12 and 18 years old (or the age of majority in your jurisdiction), you have obtained parental or guardian consent to use the Service
• Your use of the Service does not violate any applicable law or regulation

Doomersion is not directed at children under 12 and we do not knowingly collect personal information from children under 12. If you are a parent or guardian and believe your child under 12 has provided us with personal information, please contact us.

3. Account Registration and Security

To access certain features, you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may use the Service in a limited "Guest Mode" without creating an account, but certain features will be unavailable.

4. Description of Service

Doomersion is a language learning application that provides:

• A vertical scrolling feed of curated short-form video content in various languages
• Interactive, tappable subtitles with word-by-word translations and definitions
• Support for multiple languages including Spanish, Japanese, Arabic, Russian, Korean, French, Hindi, Chinese, German, Italian, and more
• Content organized by CEFR difficulty levels (A0 through C2)
• Customizable playback controls and caption settings
• Social features including video likes and comments

5. User-Generated Content

5.1 Your Content

User-generated content on Doomersion is limited to comments. When you post comments, you retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your comments in connection with operating and promoting the Service.

5.2 Community Guidelines

All user-generated content must comply with our Community Guidelines. You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
• Contains hate speech, discrimination, or promotes violence against any individual or group
• Is sexually explicit or pornographic
• Infringes on intellectual property rights of others
• Contains spam, advertising, or promotional material
• Impersonates any person or entity
• Contains malicious code, viruses, or harmful software
• Violates the privacy of others
• Targets or bullies other users

5.3 Content Moderation

We reserve the right, but are not obligated, to:

• Review, monitor, and moderate user-generated content
• Remove or disable access to any content that violates these Terms
• Report illegal activity to appropriate law enforcement authorities
• Take action against users who violate our Community Guidelines

You may report inappropriate comments using the in-app reporting feature, and you may hide comments you do not wish to see.

6. Intellectual Property

6.1 Our Content

All video content, educational materials, graphics, logos, designs, and software comprising the Service are owned by Doomersion or our content partners and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

6.2 Third-Party Content

Some videos may be sourced from third-party platforms such as YouTube. Your access to such content is subject to the terms of service of those platforms. We do not claim ownership of third-party content.

6.3 Fair Use

Doomersion's use of third-party video content for language learning purposes is intended to qualify as fair use under Section 107 of the U.S. Copyright Act. Our use is transformative in nature—we add educational value through interactive subtitles, translations, and language learning tools. We use only short clips necessary for educational purposes, and our use does not substitute for or negatively impact the market for the original works. If you are a content creator and have concerns about the use of your content, please contact us or submit a DMCA notice.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

7. Prohibited Conduct

When using Doomersion, you agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, bully, threaten, or intimidate other users
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Use automated scripts, bots, or other means to access the Service
• Interfere with or disrupt the Service or servers
• Circumvent, disable, or interfere with security features
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to send spam or unsolicited messages
• Create multiple accounts for abusive purposes
• Share your account credentials with others
• Use the Service in any manner that could damage, disable, or impair the Service

8. Account Termination

8.1 Termination by You

You may delete your account at any time by:

• In-App: Go to Settings → Account → Delete Account within the Doomersion app
• Email: Send a request to mostafa@doomlingo.ai from the email address associated with your account

Upon account deletion, we will delete your personal data in accordance with our Privacy Policy. For more information, please see our Account Deletion page.

8.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or Community Guidelines
• Engaging in prohibited conduct
• Creating risk or legal exposure for us
• Extended periods of inactivity
• Requests by law enforcement or government agencies

8.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account data, including your comments and liked videos. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, timely, secure, or error-free
• That the results obtained from using the Service will be accurate or reliable
• That any errors in the Service will be corrected

Educational Disclaimer: Doomersion is designed to supplement language learning. We do not guarantee any specific learning outcomes, fluency levels, or educational results. The effectiveness of language learning varies by individual.

Content Accuracy: While we strive for accuracy in translations, definitions, and educational content, we do not warrant that all content is error-free. Language is complex and nuanced, and translations may not capture all meanings or contexts.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOOMLINGO, ITS DEVELOPER, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any unauthorized access, use, or alteration of your content

In no event shall our total liability exceed the amount you paid us, if any, in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Doomersion, its developer, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending a notification through the app or to your registered email address

Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the Service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through:

1. Informal Resolution: We encourage you to contact us first to resolve any issues informally.
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration administered by a mutually agreed-upon arbitrator, with arbitration taking place in California.
3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Doomersion regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• No Agency: Nothing in these Terms creates any agency, partnership, or joint venture between you and Doomersion.
